§ 1 Definitions

"Accommodation provider" means a natural or legal person who provides lodging to guests in exchange for payment.

"Guest" means a natural person who makes use of accommodation services. The guest is generally also the contracting party. Persons travelling together with the contracting party (e.g. family members, friends) are also considered guests.

"Contracting party" means a natural or legal person, domestic or foreign, who enters into an accommodation contract as a guest or on behalf of a guest.

"Consumer / Entrepreneur" as defined by the Austrian Consumer Protection Act (KSchG).

"Accommodation contract" means the contract concluded between the accommodation provider and the contracting party.

§ 2 Conclusion of Contract – Deposit

2.1 The accommodation contract is concluded upon acceptance of the booking by the accommodation provider. Electronic declarations are deemed received once they are retrievable under ordinary circumstances during the business hours of the accommodation provider.

2.2 The accommodation provider is entitled to request a deposit. The contracting party will be informed of the amount prior to acceptance of the booking. The contract is concluded upon receipt of the contracting party's consent to payment of the deposit.

2.3 The deposit must be paid no later than 60 days before arrival.

2.4 The deposit is considered a partial payment towards the agreed total price.

§ 3 Start and End of Accommodation

3.1 Unless otherwise agreed, the accommodation may be occupied on the day of arrival between 3:00 PM and 7:00 PM.

3.2 If a room is occupied before 6:00 AM, the preceding night counts as the first overnight stay.

3.3 The accommodation must be vacated by 10:00 AM on the day of departure. Late departure may result in an additional day being charged.

§ 4 Cancellation by the Accommodation Provider

4.1 If an agreed deposit is not paid on time, the accommodation provider is entitled to withdraw from the contract without setting an additional deadline.

4.2 If the guest does not arrive by 7:00 PM on the agreed arrival date and no later arrival has been arranged, there is no obligation to provide accommodation.

4.3 If a deposit has been paid, the accommodation remains reserved until 12:00 PM of the following day.

§ 5 Cancellation by the Contracting Party – Cancellation Fees

5.1 Cancellation by unilateral declaration is subject to the following cancellation fees:

No cancellation fee up to 60 days before arrival. 100% of the total booking price for cancellations within 60 days before arrival.

The accommodation provider will endeavour to offer rebooking where valid reasons exist.

§ 6 Provision of Alternative Accommodation

6.1 The accommodation provider is entitled to provide equivalent alternative accommodation, provided this is reasonable and objectively justified.

6.2 Objectively justified reasons include, but are not limited to, damage, extended stays, overbookings or other operational requirements.

§ 7 Rights of the Contracting Party

7.1 The contracting party is entitled to use the booked accommodation and the facilities available to guests to the customary extent and to make use of the standard services.

§ 8 Obligations of the Contracting Party

8.1 The agreed total price including VAT and additional services must be paid no later than 60 days before arrival.

8.2 Foreign currencies may be refused. If accepted, the contracting party bears all exchange rate risks and associated costs.

8.3 The contracting party is liable for all damages caused by themselves, their fellow travellers or third parties attributable to them. A security deposit of €250 must be provided upon arrival. The deposit serves solely as security and does not constitute a limitation of liability. Damages exceeding the deposit amount must be compensated in full by the contracting party. The obligation to pay damages exists regardless of whether the deposit was actually collected or retained in whole or in part. The deposit will be refunded upon departure provided no damages are identified.

§ 9 Rights of the Accommodation Provider

9.1 The accommodation provider has the statutory right of retention and lien pursuant to §§ 970c and 1101 of the Austrian Civil Code (ABGB).

9.2 Services provided outside regular operating hours (after 8:00 PM and before 6:00 AM) may be charged separately.

9.3 The accommodation provider is entitled to issue interim invoices at any time.

§ 10 Obligations of the Accommodation Provider

10.1 The accommodation provider renders the agreed services in accordance with its standard.

10.2 Additional services not included in the accommodation price may be charged separately.

§ 11 Liability for Items Brought onto the Premises

11.1 Liability is governed by §§ 970 et seq. of the Austrian Civil Code (ABGB) and is limited to the statutory maximum amounts and existing insurance coverage.

11.2 Liability for slight negligence is excluded, except in cases of personal injury.

11.3 Liability for valuables is limited to €250, unless such items have been expressly accepted for safekeeping.

§ 12 Limitation of Liability

12.1 Towards consumers, liability for slight negligence is excluded, except in cases of personal injury.

12.2 Towards entrepreneurs, liability for both slight and gross negligence is excluded.

§ 13 Animals

13.1 Animals may only be brought with prior consent and may be subject to additional charges.

13.2 Proof of appropriate liability insurance must be provided upon request.

13.3 Animals are not permitted in communal areas or wellness facilities.

§ 14 Extension of stay

14.1 There is no entitlement to an extension of stay. Extensions are subject to availability and separate agreement.

§ 15 Termination of Contract

15.1 Fixed-term contracts end automatically upon expiry of the agreed duration.

15.2 Early departure does not entitle the guest to a price reduction, subject to saved expenses or re-letting.

15.3 The contract ends upon the death of a guest.

15.4 Immediate termination is permitted for good cause or in cases of force majeure.

§ 16 Illness or Death of a Guest

16.1 Necessary medical measures will be arranged at the guest's expense.

16.2 The accommodation provider is entitled to seek reimbursement for any costs and damages arising therefrom.

§ 17 Place of Performance, Jurisdiction and Applicable Law

17.1 The place of performance is the location of the accommodation.

17.2 Austrian law applies, excluding conflict of law rules.

17.3 Jurisdiction is governed by the mandatory provisions of consumer protection law.

§ 18 Miscellaneous

18.1 In the event of gaps in these terms, statutory provisions shall apply.

18.2 Declarations must be received by the recipient no later than the last day of a deadline.
